1. About Martinez Digital

Martinez Digital provides digital marketing services for small businesses. Services may include: Google Ads setup and management, Google business profile creation and optimisation, website creation and management, social media marketing, digital strategy, marketing audits, reporting and general digital marketing support. The exact services provided will depend on the package purchased, proposal accepted, invoice issued, contract agreed, or written agreement between us.

2. Using this website

By using this website, submitting an enquiry, creating an account, purchasing a package, or paying an invoice, you agree to these Terms & Conditions. You must not use this website in a way that is unlawful, harmful, misleading, or interferes with the security or operation of the website.

3. Services and scope of work

The scope of work will depend on the service package, proposal, estimate, invoice, contract, or written agreement provided. Any work outside the agreed scope may require a separate quote, additional fee, or updated agreement. Martinez Digital may provide recommendations, strategy, setup, management, reporting, and ongoing marketing support, but the exact deliverables will vary depending on the service purchased.

4. Prices and payment

Prices are listed in GBP unless stated otherwise. Payment is due by invoice, or according to the agreed payment plan. Work may not begin until payment and any required onboarding details, account access, files, content, approvals, or business information have been received. If payment is late, missed, declined, or cancelled, Martinez Digital may pause or delay work until payment is resolved.

5. What is not included

Unless specifically agreed in writing, prices do not include: advertising spend, domain costs, website platform fees, hosting, paid software, third-party subscriptions, premium plugins or extensions, stock photography, video, music, or creative assets, printing costs, legal, accounting, or specialist technical services. For Google Ads, social media, website, or third-party platform work, you remain responsible for any charges billed directly by those platforms.

6. Client responsibilities

To complete the work properly, you agree to provide accurate and timely information where required. This may include: business information, brand materials, website access, Google Ads access, social media account access, domain or hosting access, copy, images or content approvals and feedback, billing details or any other information needed to deliver the service. Delays in providing information, access, content, or approvals may affect project timelines and delivery dates.

7. Google Ads, social media, and third-party platforms

For Google Ads, social media, website, or other third-party platform work, you are responsible for complying with the rules, policies, and terms of those platforms. This may include platforms such as: Google, Meta, Squarespace, Instagram, Facebook, TikTok, LinkedIn, email marketing, platforms payment processors, booking tools, and analytics tools. Martinez Digital is not responsible for account suspensions, disapprovals, platform outages, policy changes, tracking limitations, or decisions made by third-party platforms.

8. Results and performance

Marketing results cannot be guaranteed. While Martinez Digital will use reasonable skill and care when providing services, performance may be affected by factors outside my control, including: advertising budget, competition, market demand, website quality, client responsiveness, offer strength, pricing, seasonality, tracking limitations, platform changes and customer behaviour. Any estimates, forecasts, or recommendations are provided as guidance only and are not guarantees of specific results, leads, sales, revenue, rankings, or return on investment.

9. Website projects

For website creation or management services, Martinez Digital may use templates, third-party platforms, plugins, integrations, or design tools. You are responsible for providing accurate business information, text, images, legal policies, product or service details, and approvals. Unless agreed otherwise, domain registration, hosting, Squarespace subscription fees, paid templates, plugins, and third-party tools are not included in the service fee.

10. Revisions and approvals

Where a service includes revisions, the number of revisions will be based on the package, proposal, invoice, or written agreement. Once work is approved, further changes may be treated as additional work and may be charged separately. If feedback or approval is delayed, project timelines may be extended.

11. Cancellations and refunds

Because Martinez Digital provides service-based packages, there are no physical items to return. If you are a UK consumer purchasing online, you may have a legal right to cancel within 14 days of purchase, unless the service has already been fully completed with your agreement. If you ask for work to begin during the 14-day cancellation period and then cancel, you may be charged for work already completed up to the point of cancellation. This may include planning, setup, research, account work, website work, campaign setup, strategy, reporting, or other time already spent on your package. Refunds are reviewed based on the service purchased, work already completed, time already allocated, and any third-party costs already incurred. Advertising spend, domain fees, website platform fees, hosting, paid software, stock assets, third-party subscriptions, and similar external costs are not refundable through Martinez Digital unless agreed separately.

12. Monthly services and subscriptions

Monthly services, retainers, subscriptions, or payment plans continue until cancelled in accordance with the agreement or subscription terms. Either party may end an ongoing monthly service by giving written notice. Cancellation will stop future work and future scheduled payments, but does not automatically refund work already completed, time already allocated, or third-party costs already incurred.

13. Intellectual property

Unless agreed otherwise, once full payment has been received, you may use the final approved materials created specifically for your business. This may include: final website content, ad copy, campaign structure, reports, social media content, written strategy, or other agreed deliverables. Martinez Digital may retain ownership of working files, templates, processes, systems, methods, know-how, draft materials, and reusable assets used to create the work. You must ensure that any content, images, logos, brand materials, or other assets you provide are either owned by you or properly licensed for use.

14. Portfolio and marketing use

Unless you ask otherwise in writing, Martinez Digital may reference your business name, project type, general work completed, or publicly available results as part of a portfolio, case study, or marketing material. Sensitive business information, private data, advertising account details, and confidential information will not be shared without permission.

15. Confidentiality

Both parties agree to keep confidential information private and not share it with third parties unless required to deliver the service, comply with the law, or with written permission. Confidential information may include account access, business plans, campaign data, customer information, financial information, strategy, and private communications.

16. Limitation of liability

Martinez Digital will provide services with reasonable skill and care.To the fullest extent permitted by law, Martinez Digital is not responsible for indirect losses, loss of profit, loss of revenue, loss of business, loss of data, platform issues, or decisions made by third-party providers. Nothing in these Terms limits liability where it would be unlawful to do so.

17. Privacy

Personal information is handled in accordance with the Martinez Digital Privacy Policy. The Privacy Policy explains how personal information is collected, used, stored, and shared when you visit this website, contact Martinez Digital, create an account, purchase a service, book a call, or otherwise interact with the business.

18. Changes to these Terms

Martinez Digital may update these Terms & Conditions from time to time. The latest version will always be available on this website.

19. Governing law

These Terms & Conditions are governed by the laws of England and Wales, unless another legal jurisdiction applies by law.
